These General Terms and Conditions of Sale (“Conditions”) govern all purchases made on [WEBSITE] (the “Website”). By placing an order, the customer accepts these Conditions, which are available before purchase and can be saved or printed.
They are governed by Spanish law, in particular Law 7/1998 of 13 April on General Contracting Conditions, Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), and Royal Legislative Decree 1/2007 of 16 November approving the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU). Nothing in these Conditions limits the rights that consumer law grants to the customer.
Orders can be delivered only to addresses in the Canary Islands. Sales are subject to the Canary Islands Economic and Tax Regime (REF) and to the Canary Islands General Indirect Tax (IGIC).
Each product page shows a description of the product and its final price, including IGIC. Shipping costs are shown separately before the order is confirmed. Before payment, the customer sees a summary of the order with the products, the IGIC, the shipping costs and the total price.
If a price shown on the Website contains an obvious error, the Seller will inform the customer before the order is accepted, and the customer may confirm the order at the correct price or cancel it at no cost.
The contract may be concluded in [LANGUAGES]. The Seller keeps an electronic record of each order, and the customer may request a copy by email.
Within 24 hours of receiving the order, the Seller will send an email confirming the order, its number, the products purchased and the final price, including any discounts. The customer should keep the order number, which is needed for bank transfer payments.
Shipping is free for orders over €50. Orders under €50 have a fixed shipping cost of €10.
The estimated delivery time is 24 to 48 hours. Times may vary with product availability; if so, the Seller will inform the customer of the new date. In any case, delivery will take place no later than 30 calendar days after the order. If it does not, the customer may cancel the order and receive a full refund. Risk of loss or damage passes to the customer on delivery.
The customer has 14 calendar days from delivery of the goods to withdraw from the contract without giving any reason. To exercise this right, the customer must inform the Seller of the decision by a clear statement sent to [EMAIL] or by post to the address above. The customer may use the model withdrawal form included with every order and attached to these Conditions, though its use is not compulsory.
The customer must return the goods within 14 calendar days of notifying the withdrawal. The direct cost of returning the goods is paid by the customer. The customer may examine the product as would be done in a shop, and is liable only for any loss in value resulting from handling beyond what is needed to establish its nature, characteristics and functioning.
The Seller will refund all payments received, including the standard initial delivery costs, within 14 calendar days of being informed of the withdrawal. The refund will be made using the same payment method used by the customer. The Seller may withhold the refund until it has received the goods back or the customer has supplied proof of having sent them, whichever is earlier.
The right of withdrawal does not apply to the products listed in Article 103 TRLGDCU, such as goods made to the customer’s specifications, perishable goods, or sealed goods unsealed after delivery that cannot be returned for health or hygiene reasons. [ADAPT TO THE PRODUCTS SOLD]
All products carry the legal guarantee of conformity of three years from delivery (Articles 114 et seq. TRLGDCU). If a product is defective or does not match the order, the customer may choose between repair and replacement, free of charge, unless the chosen remedy is impossible or disproportionate. If neither is possible, the customer may request a price reduction or termination of the contract. The Seller pays all costs of collection and redelivery in these cases.
To report a defect or a wrong delivery, the customer should contact the Seller at [EMAIL] or [PHONE].
The Seller is not liable for failure to perform these Conditions due to force majeure, to the customer’s own fault, or to unforeseeable events caused by third parties outside the contract. The Seller is not liable for damage resulting from improper use of the products.
Personal data provided by the customer is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, as described in the Privacy Policy. Data is processed to manage orders and, only with the customer’s separate consent, to send commercial communications.
If any clause of these Conditions is declared void or unenforceable by a final court decision, the remaining clauses will remain in force. The void clause will be replaced by another that comes as close as possible to its original purpose, within the limits of the law.
Complaints can be sent to [EMAIL]. The Seller will reply within one month. Official complaint forms (hojas de reclamaciones) are available on request. [The Seller adheres / does not adhere] to an alternative dispute resolution entity [NAME, if any].
Any dispute with a consumer will be heard by the courts of the consumer’s place of residence. For customers who are not consumers, the parties submit to the courts of Las Palmas de Gran Canaria.
